Welcome to OkoaChapaa. These Terms of Service ("Terms") govern your access to and use of the OkoaChapaa mobile application, website, and related services (collectively, the "Service") provided by Nakamoto Agency ("we," "us," or "our").

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the app or via email. Continued use after changes constitutes acceptance of the modified Terms.

1. Eligibility Requirements

To use OkoaChapaa, you must:

• Be at least 18 years old
• Be a resident of Kenya with valid identification
• Have a valid mobile phone number registered in your name
• Provide accurate and complete information during registration
• Not have been previously banned from using our services

We reserve the right to verify your eligibility through third-party services and may require additional documentation.

2. Account Registration and Security

2.1 Account Creation

You must create an account to access loan services. During registration, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized account use

2.2 Account Security

You are responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your password
• Logging out after each session
• Using secure devices to access the Service

3. Loan Services

3.1 Loan Application

By applying for a loan, you:

• Authorize us to verify your information through third parties
• Understand that loan approval is subject to our credit assessment
• Agree to the loan terms, interest rates, and fees disclosed during application
• Consent to credit reporting to credit bureaus

3.2 Interest Rates and Fees

All interest rates, fees, and charges will be clearly disclosed during the loan application process. These may include:

• Interest charges calculated on the principal amount
• Processing fees and service charges
• Late payment penalties
• Collection costs for defaulted loans

3.3 Repayment Terms

You agree to:

• Repay loans according to the agreed schedule
• Authorize automatic deductions where applicable
• Notify us immediately if you anticipate repayment difficulties
• Understand that late payments may affect your credit score

4. User Responsibilities

You agree not to:

• Provide false, inaccurate, or misleading information

• Reverse engineer, decompile, or disassemble the Service
• Use automated systems to access the Service
• Harass, abuse, or harm our employees or other users

5. Intellectual Property

All content, features, and functionality of the OkoaChapaa Service are owned by Nakamoto Agency and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. This license may be revoked at any time for violation of these Terms.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to:

7. Fees and Payments

7.1 Service Fees

We may charge fees for our services as disclosed during the loan application process. All fees are quoted in Kenyan Shillings (KES).

7.2 Tax Responsibility

7.3 Refund Policy

Loan processing fees and interest charges are generally non-refundable. Refunds may be considered on a case-by-case basis for legitimate errors or overcharges.

8. Termination

8.1 Termination by You

You may stop using our Service at any time. However, you remain responsible for any outstanding loans and obligations.

8.2 Termination by Us

We may suspend or terminate your access to the Service if:

• You violate these Terms
• We suspect fraudulent or illegal activity
• You default on loan repayments
• Required by law or regulatory authority

Termination does not relieve you of your repayment obligations.

9. Disclaimers and Limitations of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

9.2 Loan Decisions

We make no representations or warranties regarding loan approval. Credit decisions are based on our assessment criteria and are made at our sole discretion.

9.3 Limitation of Liability

To the maximum extent permitted by law, Nakamoto Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.

10.2 Dispute Process

In case of disputes:

1. Contact our customer support team first
2. If unresolved, disputes may be referred to mediation
3. As a last resort, disputes may be submitted to the courts of Kenya

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nakamoto Agency regarding the Service.

11.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

11.3 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms to any affiliate or successor entity.

11.4 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control.
